Noctra provides AI-powered marketing services including but not limited to: SEO, paid advertising, content creation, branding, web design, automation, and marketing consulting. The specific services you receive are outlined in your signed agreement or proposal.

What we expect from you

When working with us or using our site, you agree to:

• Provide accurate information when filling out forms or signing up for services
• Not use our website or services for any illegal or harmful purpose
• Not copy, reproduce, or resell our content or tools without written permission
• Pay for services as outlined in your agreement, on time

SMS program and messaging

By providing your phone number and opting in through any of our forms, you consent to receive SMS text messages from Noctra. These messages may include:

• Responses to your inquiry or service request
• Appointment reminders and scheduling confirmations
• Follow-up messages related to your account or services
• Updates about your marketing campaigns or reports

Message frequency varies based on your activity and engagement. You are not required to opt in to SMS as a condition of purchasing any service.

How to opt out of SMS

You can stop receiving SMS messages from us at any time. To opt out, reply STOP to any text message from Noctra. You will receive one final confirmation message and no further texts will be sent. Message and data rates

Standard message and data rates may apply to any SMS messages sent or received, depending on your mobile carrier and plan. Noctra is not responsible for any charges applied by your carrier. Check with your carrier if you have questions about your messaging plan.

Carrier liability disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to your carrier's network availability. Noctra is not responsible for any messages that are delayed, undelivered, or blocked by your carrier.

Age restriction

Our services and SMS program are intended for individuals who are 18 years of age or older. By opting in to our SMS program or using our services, you confirm that you are at least 18 years old.

Payments and refunds

Services are billed monthly unless otherwise agreed in writing. We offer a 30-day money-back guarantee for new clients. If you do not see value within the first 30 days, contact us and we will issue a full refund. After the 30-day period, all payments are non-refundable unless we have failed to deliver what was specifically agreed upon in writing.

No long-term contracts

We operate month-to-month. You can cancel at any time with written notice before your next billing date. We do not lock clients into long-term contracts. We earn your business every month.

Results and guarantees

Marketing results vary based on many factors including your market, competition, budget, and how quickly you provide us with the assets we need to do our work. We do not guarantee specific ranking positions, lead volumes, or revenue outcomes unless explicitly stated in your agreement. Our 30-day money-back guarantee covers your satisfaction with the service, not a specific performance outcome.

Intellectual property

All content we create for you as part of your service agreement — including copy, graphics, and strategy documents — becomes your property once payment is received in full. Our internal tools, processes, templates, and systems remain the property of Noctra. Our website content, logo, and branding are owned by Noctra and may not be used without permission.

Confidentiality

We treat all client information as confidential. We will not share your business details, strategies, or data with third parties unless required by law or explicitly permitted by you. We expect the same in return regarding any proprietary information, tools, or processes we share with you during our engagement.

Limitation of liability

Noctra is not liable for indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability to you for any claim is limited to the amount you paid us in the 30 days prior to the claim. We are not responsible for third-party platforms, tools, or services that we use on your behalf (such as Google, Meta, or Calendly) going down, changing their policies, or affecting your results.

Termination

Either party can end the working relationship with written notice. If you cancel mid-month, we will complete work through the end of the billing period. We reserve the right to terminate services immediately if a client engages in abusive behavior, fraud, or violates these terms.

Changes to these terms

We may update these terms from time to time. When we do, we will update the date at the top of this page. Continued use of our site or services after changes means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of California. Any disputes will be resolved in San Diego County, California.
